RESULTS ACHIEVED FOR CLIENTS
Won the appeal in the Ninth Circuit by obtaining the reversal of a judgment in favor of the Diocese of Phoenix to pay over $1,500,000 in indemnity arising out of settlements of priest child abuse claims. It was a total victory with an order for the District Court to enter judgment for Interstate Insurance Company on all claims. A published opinion has been obtained which can be used to win future cases in all of the Ninth Circuit states.
After exchange of initial disclosures, plaintiff agreed our client had no liability and moved to dismiss our client with prejudice.
Obtained summary judgment on insurance coverage breach of contract and bad faith counts with no witness depositions being taken.
Took over a case tried by another firm after a judgment was entered for more than $34 million in compensatory and punitive damages based on admitted liability. Our appeal resulted in reversal of the prior judgment and new trial on all damage issues. The case then settled for the amount offered before the first trial.
